The Special Needs Trust Fairness Act has PASSED

The SNT Fairness Act was passed by both the House and Senate on Wednesday, December 7, 2016 as part of H.R. 34, the 21stCentury Cures Act. It was signed by the President on December 13, 2016. The Special Needs Fairness Act’s primary purpose is to allow an individual to establish their own d4a special needs trust without the requirement of a parent, grandparent, legal guardian or court. The Social Security Administration (SSA) and each State will need to implement amendments and changes to existing regulations, statutes, and procedures. This will take some time. The SSA has already issued an Emergency Message directing workers to implement this change pending formal changes to the POMS and other SSA regulations/procedures.
